USCIS adjudicators issue an RFE — a request for evidence — when they believe that the visa application does not provide sufficient evidence that the petitioner or project meets the program criteria. Rather than deny it outright, they give the applicant a chance to correct or amend their application to clarify compliance. Increasingly, we’re also seeing USCIS use RFEs to get updates on EB-5 projects, especially regarding the timeline.
